AmWager and its affiliate AmWest Entertainment (“AmWest”) maintain the following policies, disclaimers and restrictions regarding wagering:

General Policies
  • AmWager/AmWest reserve the right at any time to refuse all or part of any wager.
  • AmWager/AmWest reserve the right to declare wagering closed at any time, on any pari-mutuel pool race, group of races, or for all wagering.
  • In the event that a wager is not transmitted to, received by or otherwise accepted by a racetrack for any reason (including, not limited to, mechanical, communication and human error failure), no wager will have been placed (or deemed to have been placed) on behalf of the customer, and no money will be exchanged or debited from an account holder’s account. Under no circumstances will AmWager/AmWest “book” the wager or otherwise be held responsible for the wager not being transmitted to, or received by, or otherwise accepted by the racetrack.
  • In accordance with the rules of the Internal Revenue Service, any wager resulting in winnings of $600.00 or more must be reported to the IR, if the amount of winning is at least 300 times the amount wagered . Additionally, any wager resulting in winnings over $5,000.00 is subject to reporting and withholding, if the amount of winnings is least 300 times the amount wagered. All winnings subject to reporting and/or withholding shall be reported and/or withheld by AmWest, and a copy of the Form W2-G summarizing the information will be sent to the account holder for tax purposes. It is the responsibility of the account holder to claim all gambling winnings on his or her federal and state tax returns (where applicable by law).
  • Before opening an Advance Deposit Wagering account with AmWager/AmWest, a customer must complete the entire Subscriber Application and acknowledge that he/she has read and agrees to the AmWager/AmWest Terms and Conditions Policy.

1. WHAT INFORMATION DO WE COLLECT?

a. Personal Information you disclose to us 

We collect personal information that you voluntarily provide to us when you register on our Services; express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us. 

Personal information in this policy refers to information that identifies you or is associated with you. This may include your name, mailing address, social security number, phone number, email address, birth date and bank account information. Most of this information is collected during the account setup process and is provided by the account holder. 

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information. 

We collect the following personal information you provide in connection with our Services:

  • Payment Data. We may collect data necessary to process your payment if you choose to make purchase, such as your payment instrument. All payment data is handled and stored by third parties. 

b. Sensitive Information. We may process sensitive information. 

Some of the personal information collected from you is considered sensitive in certain jurisdictions such as the last four (4) digit of your social security number and bank account information which we processed. 

c. Information automatically collected 

We automatically collect certain information when you visit, use or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, approximate and precise location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes. 

As to location, before submitting your app, you will be prompted to give permission to your precise geolocation. Giving permission is voluntary, although the denial of permission may result in your inability to wager. 

Like many businesses, we also collect information through cookies and similar technologies.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

Third-party services are not operated by AWE but may send us personal information about you. That information may be combined with your personal information and will be treated as personal information. This policy does not apply to third party companies, and we urge you to read their terms and privacy policies. We are not responsible for third party’s policies, practices, content, or accuracy. 

4. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). 

When we have ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible, then we will securely store your personal information and isolate it from any further processing until deletion is possible. 

5. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organization security measures designed to protect the security of any personal information we process. We will ensure safeguards to secure your information despite no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure. 

We will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment. 

AWE limits access to your Personally Identifiable Information to employees who require it to perform specific tasks for you or on behalf of AWE. Employees access the site’s servers using password-protected logins to safeguard against unauthorized access, acquisition, destruction, use, modification, or disclosure of information. 

6. DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly collect, solicit data from, or market to children under 18 years of age (or 21 years of age where required by law), nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 (or 21 years of age where required by law) or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years (or 21 years of age where required by law) of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 7. WHAT ARE YOUR PRIVACY RIGHTS?

Depending on your state of residency and subject to certain legal limitations and exceptions, you may be able to exercise some of all the following rights: 

Right to KnowYou can request that AWE disclose to you: (1) the pieces of personal information they have collected about you,-; (2) the personal information shared to third parties; (3) the sources for that personal information, (4) the purposes for which AWE uses that information, (5) the third parties with whom the business discloses the information, (6) the information that the business sells or discloses to third parties; (7) Whether your personal data is sold or not. You can make a request to know up to twice a year, free of charge.
Right to DeleteYou can request that AWE delete personal information collected from you and ask their service providers to do the same, subject to certain exceptions unless personal information is legally required to be kept.
Right to Opt-out of Sale or SharingYou may request that AWE stop selling or sharing your personal information (“opt-out”), including via a user-enabled global privacy control. AWE cannot sell or share your personal information after they receive you opt-out request unless you later authorize AWE to do so again.
Right to CorrectYou may ask AWE to correct inaccurate information that it has about you.
Right to Limit Use and Disclosure of Sensitive Personal InformationYou can direct AWE to only use your sensitive personal information (for example, your social security number, financial account information or your precise geolocation data) for limited purposes, such as providing you with the services you requested.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it after the processing of your personal information conducted in reliance on lawful processing grounds other than consent. 

Account Information 

If you would at any time like to review or change information in your account or terminate your account, you can request it by emailing at help@amwager.com. 

Upon your request you terminate your account, we will deactivate or delete your account information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable requirements.
